The Constitution of Mississippi is the guardian of the Government of Mississippi as the government is structured and established by the State Constitution of Mississippi. Mississippi became the 20th state of US on December 10, 1817 [1]. The Constitution of Mississippi categorizes the government into three distinct branches— the legislative, the executive and the judicial.

Executive Branch of Mississippi

The Mississippi Executive Branch is a well functioning body of the state government. Several state government departments work under the executive branch for the smooth functioning of the government. The Governor of Mississippi leads the executive branch of the government as the supreme executive head.

Governor

The Governor of Mississippi is the supreme executive head. Under the constitution, the Governor holds his office for governmentfour years. The governor sees that the laws are faithfully executed. The governor is the commander-in-chief of the army, the navy and of the militia. The governor has the power to call the legislature for meeting in extraordinary session for public interest.

Qualification of the Governor

  • The governor shall be at least thirty years of age
  • He shall be a citizen of the United States
  • He shall have resided in the state five years next preceding the day of his election.

Lieutenant Governor

The Lieutenant Governor of Mississippi is elected at the same time, for the same term, in the same manner and same qualifications as required of the Governor of the state. The Lieutenant Governor possesses the powers and discharges the duties of the office when the office of Governor is vacant, by death or otherwise when he is unable to perform the duties of the office.

Secretary of State

The Secretary of State keeps a register of all official acts and proceedings of the governor. He performs duties as is required by law. The Secretary of State is the Chief Elections Officer for the state. The office publishes the Official and Statistical Register, better known as the “Blue Book. The qualifications required for the Secretary of State are he should be minimum twenty-five years of age, a citizen of the state five years next preceding the day of his election, and he shall continue in office during the term of four years.

Mississippi Senate

The Mississippi Senate is the upper house of the Mississippi Legislature, composing 52 Senators. The lieutenant-governor is the president of the senate. The President preserves order and decorum.

House of Representatives

The House of Representatives is the lower house of the Mississippi Legislature and comprises of 122 members. It consists of members chosen every four years by the qualified electors. The Speaker presides over the House and holds office for a term of four years. He preserves order and decorum. For one to be qualified as member of the House of Representatives, he should be of the age of twenty-one years, a qualified elector of the state, and a resident citizen of the state.

Judicial Branch of Mississippi

The judicial power of the state is vested in the Supreme Court and such other courts as are provided for in the Constitution. The Supreme Court is the court of last resort in Mississippi. The judicial branch of Mississippi comprises of the following:


Supreme Court

The Mississippi Supreme Court is the court of last resort. Decisions of the Chancery, the Court of Appeals, Circuit Supreme Courtand County Courts may be appealed to the Supreme Court. The term of office of the judges of the Supreme Court is eight years. For one to be eligible to the office of judge of the Supreme Court, he should have attained the age of thirty years at the time of his appointment and should be a practicing attorney and a citizen of the state for five years immediately preceding his appointment.


Court of Appeals

The court of appeals of Mississippi hears cases assigned by the Supreme Court. The court hears and decides appeals on issues in which the law is already settled but the facts are in dispute.


Circuit Court

The circuit court has original jurisdiction in all civil and criminal matters in the state not vested in some other court. It handles cases related to felony criminal prosecutions and civil lawsuits, appeals from Justice, County and Municipal courts and from boards of administrations and commissions.


Chancery Court

The chancery court has jurisdiction in all matters in equity, divorce and alimony, matters testamentary and of administration, cases of idiocy, lunacy, and persons of unsound mind. Chancery Courts have jurisdiction over juvenile matters in counties which have no County Court.


County Courts

The county courts have exclusive jurisdiction over eminent domain proceedings and juvenile matters. The court shares jurisdiction with Circuit and Chancery Courts in some civil matters.


Justice Courts

Justice courts have jurisdiction over small claims civil cases involving amounts of $3,500 or less, any traffic offense occurring outside a municipality and misdemeanor criminal cases.


Youth Courts

The youth court deals with matters involving offenses committed by juveniles and abuse and neglect of juveniles.


Municipal Courts

The municipal courts exercise jurisdiction over municipal ordinances, misdemeanor crimes and city traffic violations.


Drug Courts

Drug courts are special courts which address crimes committed by addiction to drugs or alcohol.
